Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any application published by Appfairly ("we", "our", or "us"), including SoundCast: TV Music Visualizer and Screen Cast HDMI USB Connector, or by visiting appfairly.org (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our apps or Site.

We reserve the right to update these Terms at any time. Continued use of our apps after changes are posted constitutes your acceptance of the updated Terms.

2. Description of Services

Appfairly develops and publishes Android applications available on the Google Play Store. Our apps are designed to help users cast media from their Android devices to televisions and other display screens. Specific functionality varies by app and is described on the respective app pages and Google Play Store listings.

3. License to Use

Subject to these Terms, Appfairly grants you a limited, non-exclusive, non-transferable, revocable license to download and use our apps for your personal, non-commercial purposes on Android devices you own or control.

You may not:

  • Copy, modify, distribute, sell, or lease any part of our apps
  • Reverse engineer or attempt to extract the source code of our apps
  • Use our apps for any unlawful purpose or in violation of any regulations
  • Use our apps to infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to any part of our apps or their related systems

4. Third-Party Services

Our apps may integrate with or require third-party services including, but not limited to:

  • Google Play Services — required for app functionality on Android
  • Google AdMob — used to display advertisements in certain apps
  • Spotify — used within SoundCast to enable music playback (requires a valid Spotify account and subscription)
  • YouTube Music — used within SoundCast to enable music playback (requires a valid YouTube Music account)

Your use of these third-party services is governed by their respective terms of service and privacy policies. Appfairly is not responsible for the practices or content of any third-party services.

5. Intellectual Property

All content, features, and functionality of our apps and this Site — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Appfairly or its licensors and are protected by applicable intellectual property laws.

The Appfairly name, logo, and all related product names are trademarks of Appfairly. You may not use these marks without our prior written permission.

6. User Conduct

You agree to use our apps only for lawful purposes. You are solely responsible for any content you access, display, or share using our apps. You must comply with all applicable laws and the terms of any third-party services you use in conjunction with our apps.

7. Disclaimer of Warranties

Our apps are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Appfairly does not warrant that:

  • Our apps will function uninterrupted or error-free
  • Any defects will be corrected
  • Our apps are free of viruses or other harmful components
  • The results of using our apps will meet your expectations

Device compatibility (such as DisplayPort Alt Mode support for HDMI output) depends on your hardware and is outside our control. We provide compatibility checking tools but cannot guarantee functionality on every device.

8. Limitation of Liability

To the fullest extent permitted by law, Appfairly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your use of our apps, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of our apps shall not exceed the amount you paid for the app in question (which for free apps is $0).

9. Indemnification

You agree to indemnify and hold harmless Appfairly and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our apps, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your access to our apps at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion. Upon termination, your license to use our apps will immediately cease.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our apps will be resolved in the courts of competent jurisdiction in the United States.

12. Changes to These Terms

We may revise these Terms from time to time. We will update the "Last updated" date at the top of this page when we do. Your continued use of our apps after any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using our apps.
